How to Go Where Angels Fear to Tread: Fair Use of Copyright, Trademark and Rights of Publicity with Moses Singer LLP

Intellectual property experts from Moses Singer will explain the legally permissible ways in which producers can use copyrighted works, trademarks and names, likenesses and individual  personas without incurring liability for infringement.

Elizabeth A. Corradino, David Rabinowitz and Toby Butterfield will address fair use of both copyrighted works and trademarks, and non-commercial or otherwise permissible references to famous (and non-famous) individuals. The panel will discuss the limits of these concepts, and ways to mitigate risk when relying on them.

Panelists

Toby Butterfield is a Partner in Moses Singer’s Intellectual Property, Entertainment/Media & Technology and Litigation practice groups. He has 25 years of experience litigating and counseling on copyright, trademark, defamation, software and digital media, and commercial matters. His clients include media and entertainment companies, motion picture and theater producers, major brand owners, technology companies and designers of luxury goods.

 

Elizabeth A. Corradino is the Chair of the Intellectual Property, Entertainment/Media & Technology practice group and has a diverse practice focused on solving the legal and business issues affecting content creators and distributors across digital and traditional media platforms.

 

 

 

David Rabinowitz is a partner in Moses Singer’s Litigation, Intellectual Property and Law Firms practices, has been a partner with the firm since 1985. Within a broad commercial litigation and litigation counseling practice, David has focused in the substantive areas of financial industry litigation, including corporate trusts and letters of credit, trusts and estates, intellectual property, contracts and employment. David has represented major financial institutions in matters relating to indenture trusts, letters of credit, negotiable instruments and electronic transfers, real estate and cross-border judgment enforcement.

Maud Kersnowski-Sachs (moderator) leads fundraising efforts and strategies for NYWIFT. Working closely with the Development Committee and the Executive Director, she directs corporate, philanthropic, and government partnerships. Maud also manages publications projects for the organization. Maud has led publications for the Sundance Film Festival, Tribeca Film Festival, and the Association on Independent Video and Filmmakers (AIVF) and the editor-in-chief of The Independent Film & Video Monthly. She has covered arts, entertainment, and media for publications from Metropolis Magazine to IndieWIRE, where she also held the post of West Coast Editor. She consults on editorial and development projects for a variety of arts and culture organizations. Maud founded and manages a scholarship and engagement program at Bard College’s Fisher Center for the Performing Arts and is a member of the Bard College Board of Governors.  She holds a BA in Women’s Studies from Bard College and an MA in Cultural Reporting and Criticism from the NYU School of Journalism.
